Senate Resolution 003-09 Judicial Bylaws

Judicial Bylaws

Be it resolved by a quorum of the Senate of the Southern Utah University Student Association that the Judicial Council of the SUUSA Student Government is encouraged to provide the first draft of its Bylaws by Friday November 7, 2008.
Whereas: Currently the Judicial Council is operating without Bylaws and;
Whereas: The Judicial Council is the governing body of the SUUSA Student Government and should set an example to the other branches of how it feels they should implement Bylaws within their branches;
Whereas: Without Bylaws, the Judicial Council has a lot power when interpreting the SUUSA Student Government Constitution and;
Whereas: Without Bylaws, The Judicial Council has no set structure of meetings or policies to follow.
Therefore, let it be resolved by a quorum of the Senate of the Southern Utah University Student Association that the Judicial Council of the SUUSA Student Government is encouraged to provide the first draft of its Bylaws by Friday November 7, 2008.

I read the newspaper article and thought "Cool, a showdown between two branches of student government." I mean, even if the idea is a stupid one (by-laws for like 4-5 people?), at least student government is pretending to have some sort of checks and balances.

But wait. Is this a resolution to "encourage" something? Wow. I'm glad the PVA senators have nothing better to do than "encourage" other people to do things. I might be mistaken, but if Senators Cook and Larsen wanted to tell people "Hey, we'd love it if you did X," they could do that without wasting the Senate's time on it. This isn't a check or balance. It's a desperate plea. True, it's a desperate plea with a deadline, but still. How embarrassing.

as a member of student goverment i know how importand by-laws are. the assembly and senate had to have their by-laws passed by the second week of school and we both made that top priority. by-laws are important to senate and assembly and jc shouldn't be any different. they have alot of power and without by-laws they pretty much can do whatever they want.

First of all, this is not a showdown between two branches of government. This piece of legislation has to come through Senate to be constitutional. Second, the amount of people in the organization is irrelevant to the need for by-laws. Our system allows one person, the President, to hold the same power that a body of 21, the Senate, does.
Senator Cook and I volunteered to bring this resolution to the table after a decision was reached by the Senate in our Executive session to encourage the Judicial Council to provide a first draft of their By-laws.
I appreciate your concern with whether or not we are wasting the Senate's time, but again point out that this was a decision which the Senate, as a body, had previously agreed was necessary. In essence saying that it was a valuable use of their time not a 'waste' or a 'desperate plea' as has been suggested.
