Updated USCIS Policy: New Photo and Biometrics Standards
As of December 12, 2025, U.S. Citizenship and Immigration Services (USCIS) has implemented revised protocols regarding the collection and reuse of applicant photographs and biometric data. Under this new guidance, USCIS discourages self-provided photos for many processes, instead preferring images captured directly by authorized government personnel.
Major Policy Shifts
- Authorized Captures Only: USCIS now primarily accepts photographs taken during a Biometrics Services Appointment (BSA) at an Application Support Center (ASC) or via other government-sanctioned entities.
- Restricted Reuse: For most immigrant and citizenship filings, the agency will no longer recycle old photos on file.
- Three-Year Rule for Nonimmigrants: For applications such as Form I-765 (OPT/STEM OPT), USCIS may choose to reuse a photo already in their system, provided it was taken within the last three years. However, this remains entirely at the agency's discretion.
What This Means for Students (OPT and STEM OPT)
If you are submitting a Form I-765 for work authorization, please be aware of the following:
- Possible Biometrics Appointment: You may receive an official notice in the mail requiring you to visit an ASC for a photo and fingerprinting session. If you receive such a notice, follow the scheduling instructions promptly. If a visit to an ASC location is necessary, applicants residing in Cedar City are typically directed to the ASC location in Las Vegas
- Current Submission Advice: Because official form instructions are still being updated, our office recommends that your continue to include two physical passport-style photos with your EAD applications for the time being.
- Stay Alert: Monitor your mail and USCIS online account for any "Request for Evidence" (RFE) or appointment notices related to your biometrics.
